TERMS AND CONDITIONS:
By purchasing through this website you agree to be bound by the Terms and Conditions laid out below. These terms and conditions apply to website transactions only and do not apply to any purchases made in our Retail Bed Warehouses outlets in Scarborough or Bridlington. These conditions do not affect your statutory rights as a Consumer.
Definitions
"Buyer" means the Consumer who buys or agrees to buy Goods on this website from
bedwarehouse.com.
"Goods" means all products listed on the order and the order confirmation e-mail
"Consumer" has the meaning given in section 12 Unfair Contract Terms Act 1977
"Special Items" means any Goods that are not held in stock by
bedwarehouse.com and are ordered and/or manufactured specifically for the Buyer.
"Delivery" means the delivery of the Goods to the delivery address specified on the order.
Risk and Ownership
Once delivery has taken place, the Goods shall be at the Buyer's risk. The Buyer must take all reasonable care of the Goods. Should the Goods, having been damaged while in the Buyer's care, be returned to
bedwarehouse.com, the cost of such damage will be recovered from the Buyer.
Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place.
Limitations of Liability
Our total liability in regard to this contract shall be limited to the value of the Goods.
bedwarehouse.com shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract.
All contracts shall be governed by English Law
Any order placed by the Buyer and accepted by
bedwarehouse.com is subject to the following terms and conditions unless specified in writing by a Proprietor of bedwarehouse.com.
A confirmation of your order will be sent by e-mail and, unless you are notified to the contrary within 72 hours of this confirmation, the order will be deemed to be accepted by
bedwarehouse.com.
bedwarehouse.com retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.
Description of goods
The description of the goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the Goods specified are as the Buyer intended to order.
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including product descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted.
All sizes given are approximate and the Buyer should satisfy them self that the goods will fit into the delivery address. The normal bed and mattress sizes (i.e. 3, 0" single 4'6" double and 5'0" king) refer to the sleeping surface only and the Buyer should check the overall dimensions given for each product. The illustrations of colours and covers are representative only. We make every effort to ensure that colours are as close as possible to the actual colours however there may be slight variations due to the nature of the medium or very occasionally the covers may differ if the manufacturer has deemed it necessary to use an alternative cover of equal quality.
There may be certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order, (for example, pillows, headboards and bedcovers).
Payment
A deposit is required at the time the order is placed and
bedwarehouse.com will collect the payment from the debit/credit card details supplied.  The balance to be paid when the good are ready for dispatch to the customer.
All Prices and charges on this site are in U.K. pounds and include any V.A.T payable at the prevailing rate.
Order Acceptance
Order acceptance and the completion of the contract between you and us will take place on the dispatch of the products ordered to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with our cancellation policy.
Non-acceptance of an order may be a result of one of the following:
Our inability to obtain authorization for your payment.
The identification of a pricing or product description error.
You not meeting the eligibility to order criteria set out below.
If there are any problems with your order, you will be contacted by our Customer Services Representatives.
The sales contract is therefore completed in England.
We reserve the right to reject any offer to purchase by you at any time.
Refusal Of Transaction
We reserve the right to withdraw any Products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
To be eligible to purchase Products on this Website and lawfully enter into and form contracts on this Website under English law you must:
1. Be over 18 years of age
2. Stipulate a delivery address in the United Kingdom including postcode. Please note that PO box numbers, and accommodation addresses are not acceptable
3. Possess a valid credit or debit card issued by a bank acceptable to us.
Delivery
Delivery will normally take place within the timescales estimated on the order confirmation. If for any reason this deadline cannot be met, you will be contacted as soon as this becomes apparent to us.  We aim to deliver the majority of out beds and mattresses within 14 working days. You will be notified immediately if we have any stock issues on your order. Delivery is limited to Mainland UK only. For the delivery of Goods delivered within 25 miles of Bridlington or Scarborough, North Yorkshire, U.K a £15 charge is made.  Please call us for delivery charges to other areas. At bedwarehouse.com we have good relationships with our suppliers and as such several are able to offer direct home delivery to our customers, e.g. Silentnight, Sealy, Rest Assured. We like to make the delivery as easy as possible; as soon as your goods are available a dispatch coordinator will ring to arrange a specific delivery day, booked with you personally over the telephone to ensure you can be there to accept delivery.
Delivery must be arranged within 5 days of the goods arriving at the distribution warehouse.
bedwarehouse.com retains the right to charge storage at £6 per week for Goods that are not delivered within two weeks of receipt into our warehouse (Maximum £60 per order).
Where the Goods cannot be delivered on the day arranged due to the fault of the buyer,
bedwarehouse.com retains the right to charge £25 for "re-delivery" to cover costs incurred. This charge will be taken from the debit/credit card used to purchase the Goods.
If
bedwarehouse.com has failed to deliver the Goods within 30 working days of the order date due to its own neglect (on either stock or special items) then the Buyer may either cancel the contract without penalty and bedwarehouse.com refund your monies in full.

Delivery is officially to the front door only but if access is clear Goods may be taken to the room of choice at the driver's discretion and at the customer's risk. On delivery you will be given ample time to check your goods carefully for any visible damage before you sign for them.
Most Goods will require some form of assembly and it is the Buyer's responsibility to assemble the Goods.
Delivery will only be made to the delivery address specified on the original order.
Delivery will be deemed to have taken place when the Goods have been delivered to the agreed address (
bedwarehouse.com does not need to satisfy themselves that the person accepting delivery at the agreed address is authorized by the Buyer to accept the Goods)
Guarantees
All Goods are guaranteed against faulty materials and workmanship for a minimum period of twelve months from the date of delivery.
Faulty Goods
Complaints relating to faulty Goods should be notified in writing within 7 days of the fault becoming apparent and should be addressed to Customer Services Department,
bedwarehouse.com, Bed Warehouse, Wrea Lane, Scarborough, North Yorkshire or by e-mail to customerservices@bedwarehouse.com. In the rare event that Goods develop a fault, bedwarehouse.com retains the right to have the Goods repaired or replaced at bedwarehouse.com's discretion, and any delivery costs associated with the exchange of faulty Goods will be met by bedwarehouse.com.
Where Goods are reported as faulty later than seven days after delivery, we reserve the right to arrange an independent inspection and if the Goods are found on inspection to not be faulty but the result of fair wear and tear, negligence or wilful damage,
bedwarehouse.com retains the right to charge £25 for the inspection to cover its costs. This charge will be taken from the debit/credit card used to purchase the Goods. The Buyer and bedwarehouse.com shall both agree to be bound by the results/findings of the independent inspector.
Refunds
Refunds on Goods cancelled prior to delivery will be made as soon as possible following written notification of cancellation and in any case will not exceed a period of 30 days of that written notice. All refunds will be made onto the same card used to make the original purchase.
Refunds on Goods already delivered will take place as soon as possible following the collection, return and inspection of such goods and in any case will not exceed a period of 30 days following that collection/return.
Cancellation
For goods ordered via this site only the buyer may cancel the goods at any time within the cancellation period by giving
bedwarehouse.com notice of the cancellation in writing or in another durable medium.
Cancellation period for internet orders only: Any time up to seven working days following the delivery of the goods. Excepting: Goods that have been manufactured specifically for the Buyer - these cannot be cancelled once the order has been accepted by
bedwarehouse.com.
Due to the intimate nature of Beds, mattresses, pillows, mattress protectors, duvets etc, these items are exempt from the statutory 7 day cooling off period under the Distance Selling Regulations when they have been unsealed. Therefore, for reasons of health and hygiene any beds, mattresses or bedding that has been unsealed will be deemed to be used and cannot be returned for any reason other than a manufacturing fault.
The Buyer must retain the Goods and take good care of them until they are collected by
bedwarehouse.com or their agents.
The Goods must be unused, made available for collection and be in the original packaging and in the original condition at a time requested by
bedwarehouse.com (this request not to exceed 21 days from the cancellation date)
There is a collection charge of £25 for
bedwarehouse.com to collect the Goods or the Buyer may return the Goods (at the Buyers cost) and unused, to us at bedwarehouse.com, Bed Warehouse Wrea Lane, Scarborough, North Yorkshire. YO12 7PN in the original packaging and in the original condition, the collection charge will be deducted from the refund value and the original delivery charge is non refundable.
Should the Goods not be adequately packaged at the time of collection then they will not be collected and
bedwarehouse.com retain the right to charge £25 for "re-collection" to cover costs incurred. The "re-collection" charge will be deducted from the refund value.
Following collection or return, should Goods be found to be damaged (not in their original condition), and the Damage is not the result of our actions or negligence,
bedwarehouse.com will deduct a reasonable amount from the refund to cover such damage. (such amount not to exceed the price of the Goods). Should the buyer unreasonably fail or refuse to make the Goods available to us when requested within 21 days then the Goods must be kept and good care taken of them until they are collected or returned.
No refund shall be made until the Goods have been collected/returned and inspection made as to their condition.
