TERMS
AND CONDITIONS:
By purchasing through this website you agree
to be bound by the Terms and Conditions as set out below.
These
terms and conditions apply to online transactions only and do not
apply to any purchases made in a Bed Warehouse Retail Shop/Warehouse.
These
conditions do not affect your statutory rights as a Consumer
Definitions:
"Buyer" means the Consumer who buys or agrees to buy Goods on this
website from Bedwarehouse.com.
"Goods"
means all products listed on the order and the order confirmation
e-mail
"Consumer" has the meaning given in section 12 Unfair Contract Terms
Act 1977
"Special
Items" means any Goods that are not held in stock by Bedwarehouse.com
and are ordered and/or manufactured specifically for the Buyer.
"Delivery" means the delivery of the Goods to the delivery address
specified on the order.
Risk and
Ownership:
The Goods shall be at the Buyer's risk once delivery has taken place.
The Buyer must take all reasonable care of the Goods. Should the Goods
be returned to Bedwarehouse.com having been damaged while in the
Buyer's care, the cost of such damage will be recovered from the
Buyer.
Ownership of the Goods will only pass when cleared funds have been
received from the Buyer, regardless of whether delivery has taken
place.
Limitations of Liability:
Our total liability in regard to the performance of this contract
shall be limited to the value of the Goods.
Bedwarehouse.com shall not be liable for any direct, indirect or
consequential losses, costs or expenses incurred or any consequential
compensation arising out of the performance/or non performance of this
contract.
Nothing
in these terms and conditions excludes or limits liability for death
or personal injury caused by negligence, fraudulent misrepresentation
or any other liability which may not otherwise be limited or excluded
under applicable law.
All
contracts shall be governed by English Law
Any
order placed by the Buyer and accepted by Bedwarehouse.com is subject
to the following terms and conditions unless specified in writing by a
Director of Bedwarehouse.com.
A
confirmation of your order will be sent automatically by e-mail and,
unless you are notified to the contrary within 5 working days of this
confirmation, the order will be deemed to be accepted by
Bedwarehouse.com. Bedwarehouse.com reserve the right to cancel all
confirmed orders that are subject to genuine website error or
inaccuracy and will in these circumstances reimburse the Buyer in
full.
Typographical Errors
In
the event a product is listed at an incorrect price due to
typographical error or error in pricing information from our
suppliers, taxes or duty changes, we shall have the right to refuse or
cancel any orders listed at the incorrect price whether or not the
order has been confirmed. If your credit card has already been charged
and we subsequently cancel your order, we will immediately issue a
refund to your credit card account in the value of monies paid
(including delivery charges).
All
products offered are subject to availability.
Please
be aware that not all products illustrated on our website are on
display in our retail outlets - space obviously limits us as to just
how much we are able to display.
Also we
often have in store products not shown on our website.
There
may be occasions too when the offers/prices instore differ from that
on this website and vice versa.
Fraud
Prevention:
Bedwarehouse.com retains the right to investigate any order placed on
this website that it suspects to be fraudulent, any such order will
not be delivered until it is proven that the order is bona fide.
Should Bedwarehouse.com be unable to prove that an order is bona fide
or to contact the Buyer then the monies will be refunded to the
original card used to place the order and the order will be cancelled.
For your
protection, to ensure that your credit, debit or charge card is not
being used fraudulently, we will validate your name, address and other
personal information supplied by you during the order process against
appropriate third party databases. By accepting these terms and
conditions you consent to such checks being made. All
information provided by you will be treated securely and strictly in
accordance with the Data Protection Act 1998.
Sizes/Finishes/Descriptions/Specifications:
The
description of the goods will be as specified within the confirmation
e-mail and it is the Buyers responsibility to check that the Goods
specified are as the Buyer intended to order. Images of products are
examples of the finished product and goods are supplied on the
understanding that there may be slight variances in colour, finish,
shade and grain particularly on wooden and metal products. Raw
materials may have minor technical variances and products may differ
marginally from the goods shown. Any changes made will be of an
equally or higher standard.
All
sizes quoted are approximate and the Buyer should satisfy them self
that the goods will fit into the delivery address. The normal bed and
mattress sizes (i.e.2’6” small single, 3’ 0" single, 4’0” ¾ Bed, 4'6"
double, 5'0" king, and 6’0” Superking) refer to the sleeping surface
only and the Buyer should be aware that the overall dimensions may be
greater. There may be certain items included in the illustration of a
product which are not part of the product and are not included in the
product description and are not part of the order, (for example,
mattresses on bedsteads & bunks, bedside tables, lamps and bedcovers).
Payment:
Full payment is required at the time the order is placed and
Bedwarehouse.com will collect the payment from the debit/credit card
details supplied.
All
Prices and charges on this site are in U.K. pounds and include any
V.A.T payable at the prevailing rate.
For
Logistical reasons, the prices of some products purchased in our
Retail Warehouses may not be exactly the same as the prices for those
products purchased online at www.bedwarehouse.com.
Delivery:
We are
currently giving
*Free
Delivery
on-line for almost all
Silentnight
Beds and Mattresess and
*Free Delivery on all
Sealy Beds. Delivery is also free on all Sealy mattresses at £300 and above.
Many
other items also have
Free
Delivery
when ordered on line, whilst some others may incur our standard
delivery charge of £19 (£9.50 for some smaller items).
Deliveries are 2 man for large items and these may be taken to the
room of your choice if the access is clear. Most Goods will be
delivered directly from our suppliers and others by a professional
logistics team appointed by us. Smaller Goods may be delivered by post
or courier.
Deliveries are Monday to Friday, to Mainland UK, excepting for the
following post code areas, which may carry a surcharge - AB, FK, IV,
KW, LL, PH, PA, SA, SY. For delivery charges to these areas
please phone 0800 633 5892.
Delivery
will only be made to the delivery address specified on the original
order.
Delivery
will be deemed to have taken place when the Goods have been delivered
to the agreed address (Bedwarehouse.com do not need to satisfy
themselves that the person accepting delivery at the agreed address is
authorised by the Buyer to accept the Goods)
You will
be given ample time to check your goods carefully for any visible
damage before signing for them. Please note that it is your
responsibility to sign for the delivery as received, should your
packaging be damaged, please mark this on the delivery note as failure
to do so may result in any future claim for replacements due to damage
being invalidated.
Delivery
is officially to the front door only but Goods may be taken to the
room of your choice if the access is clear. It is the customer's
responsibility to ensure that the goods will fit into the chosen
location and that there is satisfactory access to the chosen location.
Most
Goods will require some form of assembly and it is the Buyer's
responsibility to assemble the Goods. Delivery charges do not include
unpacking or assembly. Please inspect all goods on delivery and advise
us of any visible damage as soon as possible and in any case within 7
days.
The
deliverers will not remove existing pieces of furniture to help make
room for newly delivered products. Likewise, old pieces of
furniture will not be taken away. The customer must take the
responsibility to organize the removal and disposal of unwanted
furniture.
Bedwarehouse.com will not accept liability for damage to the
customers property, including all types of fixtures, fittings and
building structure during delivery of the goods. Any consequent
damage should fall under the customer's household insurance.
Bedwarehouse.com will not accept any liability for any damage caused.
Customers are advised when accepting goods to have protective sheets
available as the goods being delivered may have transferred through a
number of warehouses and delivery vehicles.
Where
the Goods cannot be delivered on the day arranged due to the fault of
the buyer, Bedwarehouse.com retains the right to charge a further £40
for "re-delivery" to cover costs incurred. This charge will be taken
from the debit/credit card used to purchase the Goods.
Refunds:
Refunds
on Goods cancelled prior to delivery will be made as soon as possible
following written notification of cancellation and in any case will
not exceed a period of 21 days of that written notice. All refunds
will be made onto the same card used to make the original purchase.
Refunds
on Goods already delivered will take place as soon as possible
following the collection, return and inspection of such goods and in
any case will not exceed a period of 21 days following that
collection/return.
Cancellation:
The Buyer may cancel the goods at any time within the cancellation
period by giving Bedwarehouse.com notice of the cancellation in
writing or in another durable medium.
Cancellation period
&
Returns under the 7 Day Home Approval
If you are unhappy with your purchase or change your mind, and notify
us within 7 days of delivery, we will offer you a choice of either
exchange to another product or collection and refund of the goods.
Although we reserve our right to recover the cost of collection, which
would be deducted from the refund amount.
This applies only to Goods featured on Bedwarehouse.com web site i.e.
Regular lines. Special Items i.e. Goods that are not a regular line for
Bedwarehouse.com and are ordered and/or manufactured specifically for
the Buyer cannot be cancelled once the order has been accepted by
Bedwarehouse.com.
Please
be aware that due to the intimate nature of Beds, mattresses, pillows,
mattress protectors, duvets etc, these items are exempt from the
statutory 7 day cooling off period under the Distance Selling
Regulations when they have been unsealed. Therefore, for reasons of
health and hygiene any beds, mattresses or bedding that has been
unsealed will be deemed to be used and cannot be returned for any
reason other than a manufacturing fault.
The
Goods must be unused, made available for collection and be in the
original packaging and in the original condition at a time requested
by Bedwarehouse.com (this request not to exceed 21 days from the
cancellation date)
The
Buyer must retain the Goods and take good care of them until they are
collected by Bedwarehouse.com or their agents.
There is
a collection charge of £49 for Bedwarehouse.com to collect the Goods
or the Buyer may return the Goods (at the Buyers cost) and unused, to
us at Bedwarehouse.com, Wrea Lane, Scarborough, North Yorkshire, YO12
7PN in the original packaging and in the original condition, the
collection charge will be deducted from the refund value and the
original delivery charge is non refundable.
Should
the Goods not be adequately packaged at the time of collection then
they will not be collected and Bedwarehouse.com retain the right to
charge a further £49 for "re-collection" to cover costs incurred. The
"re-collection" charge will be deducted from the refund value.
Following collection or return, should Goods be found to be damaged
(not in their original condition), and the Damage is not the result of
our actions or negligence, Bedwarehouse.com will deduct a reasonable
amount from the refund to cover such damage. (Such amount not to
exceed the price of the Goods).
Should
the buyer unreasonably fail or refuse to make the Goods available to
us when requested within 21 days then it will be deemed that the buyer
has decided to keep the goods at the price paid and in the condition
they are in. Goods must be kept and good care taken of them until they
are collected or returned.
No
refund shall be made until the Goods have been collected/returned and
inspection made as to their condition.
Guarantees:
All Goods are guaranteed against faulty materials and workmanship for
a minimum period of twelve months from the date of delivery.
Returns
of incorrect, faulty or damaged goods:
Complaints relating to incorrect, faulty or damaged Goods should be
notified by phone on 0800 633 5892 and in writing within 7 days of
delivery and should be addressed to Customer Services Department,
Bedwarehouse.com, Wrea Lane, Scarborough, North Yorkshire, YO12 7PN or
by e-mail to
online@bedwarehouse.com.
We will offer you either the choice of an exchange of faulty part or
product; or Collection with full refund. This does not affect
your statutory rights. In the rare event that Goods develop a
fault, Bedwarehouse.com retains the right to have the Goods repaired
or replaced at Bedwarehouse.com’s discretion, and any delivery costs
associated with the exchange of faulty Goods will be met by
Bedwarehouse.com.
Where
Goods are reported as faulty later than seven days after delivery, we
reserve the right to arrange an independent inspection and if the
Goods are found on inspection to not be faulty but the result of fair
wear and tear, negligence or wilful damage, Bedwarehouse.com retains
the right to charge £50 for the inspection to cover its costs. This
charge will be taken from the debit/credit card used to purchase the
Goods. The Buyer and Bedwarehouse.com shall both agree to be bound by
the results/findings of the independent inspector.

INACCURACY POLICY
The
information, services and products provided on and throughout this
site are subject to change without notice. In the event of a genuine
website error or inaccuracy we reserve the right to withdraw an offer
immediately. www.Bedwarehouse.com reserves the right to cancel
all confirmed orders that are subject to genuine website error or
inaccuracy. The price of any item purchased online may differ in
price from that same item available in one of our stores;
sometimes this will be lower and occasionally higher. All
products offered are subject to availability.
