1. About These Terms

1.1 These Terms & Conditions apply to all purchases made in-store at Scarborough Bed Warehouse.
1.2 We are a bricks-and-mortar retailer only and do not sell products through our website.
1.3 By purchasing goods from us, you agree to be bound by these terms alongside your statutory rights under UK consumer law.

2. Products

2.1 We sell beds, mattresses, and bedroom furniture for domestic use.  All beds and mattresses comply with resistance to ignition regulation BS7177: 2008 for "low hazrd" use unless otherwise stated.

2.2 All products are subject to availability. Display models may vary slightly in colour, fabric, or finish from manufacturer images due to lighting and materials.
2.3 Measurements are approximate; customers are responsible for ensuring items will fit into their property and chosen room.

3. Prices & Payment

3.1 All prices are shown in pounds sterling and include VAT where applicable.
3.2 We reserve the right to change prices at any time prior to purchase.
3.3 Payment is required in full before delivery or collection unless a written agreement is made for a deposit arrangement.
3.4 Accepted payment methods will be advised in store.

4. Orders

4.1 A contract is formed when we accept your order in store and payment (full or deposit) has been taken.
4.2 Special order or bespoke items made to your specification cannot be cancelled or refunded once the order has been placed with the manufacturer.

4.3 Where a customer orders an item from a catalogue, brochure, or supplier images that has not been physically viewed in our store, the item is ordered at the customer’s own risk. The customer accepts responsibility for their choice of style, comfort, colour, size, and suitability, and such items may not be refused or returned on the basis of appearance, comfort, or change of mind.

5. Delivery

5.1 We offer free delivery within a 25 mile radius of our store. A delivery charge may be required for addresses outside of this distance or where delivery is arranged for a different day to our normal delivery schedule.
5.2 Delivery dates are estimates only; we are not liable for delays outside our reasonable control.

5.3 Delivery is our responsibility to your entrance door only. If we agree to deliver to your room of choice, we will not accept resposibility for damage to your property other than due to our negligence when our liability is limited to the repair of that damage with no element of betterment.

5.4 Customers must ensure suitable access for delivery. Additional charges may apply if delivery cannot be completed due to restricted access.
5.5 Risk in the goods passes to the customer upon delivery.

6. Collection

6.1 Goods may be collected by arrangement.
6.2 The customer is responsible for the safe transportation of items once they leave our premises.

7. Your Right to Cancel or Return

7.1 As purchases are made in person in store, there is no automatic right to cancel under the Consumer Contracts Regulations that apply to online sales.

7.2 Returns or exchanges are offered at our discretion and goods must be:

• Unused and in original condition

• Free from marks, odours, or damage

• Returned within the period agreed at point of sale (if any)

7.3 For hygiene reasons, mattresses and bedding cannot be returned once unwrapped unless faulty.

8. Faulty or Damaged Goods

8.1 If goods are faulty, not as described, or not of satisfactory quality, you are protected by the Consumer Rights Act 2015.
8.2 Please notify us as soon as possible if a fault is discovered.
8.3 We may offer repair, replacement, or refund depending on the nature of the issue and the time since purchase.
8.4 Normal wear and tear, misuse, or accidental damage are not covered.

9. Manufacturer Guarantees

9.1 Some products are supplied with a manufacturer’s guarantee.
9.2 Guarantees are subject to the manufacturer’s terms and do not affect your statutory rights.
9.3 We will assist customers in liaising with manufacturers where appropriate.

10. Liability

10.1 We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any matter it would be unlawful to exclude.
10.2 We are not liable for indirect or consequential losses arising from the purchase or use of our products.

11. Data Protection

11.1 We collect only the personal information necessary to process your order and arrange delivery.
11.2 Your data will be handled in accordance with UK data protection law and will not be shared with third parties except where required to fulfil your order.

13. Governing Law

13.1 These terms are governed by the laws of England and Wales.
