This page sets out the Terms and Conditions on which we sell any of the Goods listed on our website (the Goods) bedwarehouse.com (our site).

Please read these Terms and Conditions carefully before ordering any Goods from our site. When placing an order, you will be invited to agree to these Terms and Conditions by ticking the box marked "I agree to the terms and conditions". If you don't accept the Terms and Conditions by ticking this box, you will not be able to order any Goods from our site. We recommend that you print a copy of these Terms and Conditions for future reference.
These terms and conditions apply to online transactions only and do not apply to any purchases made in store.
The contract between us (our Contract) will only be made when we send you the email confirming acceptance of your order.
These conditions do not affect your statutory rights as a Consumer.
"Buyer" means the Consumer who buys or agrees to buy Goods on this website from Bedwarehouse.com.
"Goods" means all products listed on the order and the order confirmation e-mail
"Consumer" has the meaning given in section 12 Unfair Contract Terms Act 1977
"Special Items" means any Goods that are not held in stock by Bedwarehouse.com and are manufactured specifically for the Buyer.
"Delivery" means the delivery of the Goods to the delivery address specified on the order.
Our site is intended for use by people resident in mainland Great Britain. We currently do not accept orders online where delivery is required to locations outside the following North Yorkshire post code areas:
Scarborough: YO11, YO12, YO13
Bridlington: YO15, YO16
Whitby: YO21, YO22
By placing an order on our site you warrant that:
The Goods shall be at the Buyer's risk once delivery has taken place. The Buyer must take all reasonable care of the Goods. Should the Goods be returned to Bedwarehouse.com having been damaged while in the Buyer's care, the cost of such damage will be recovered from the Buyer.
Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place.
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law. All contracts shall be governed by English Law. Any order placed by the Buyer and accepted by Bedwarehouse.com is subject to the following terms and conditions unless specified in writing by a Director of Scarborough Bed Warehouse Ltd.
A confirmation of your order will be sent automatically by e-mail and, unless you are notified to the contrary within 5 working days of this confirmation, the order will be deemed to be accepted by Bedwarehouse.com. Bedwarehouse.com reserve the right to cancel all confirmed orders that are subject to genuine website error or inaccuracy and will in these circumstances reimburse the Buyer in full
The price of the Goods will be as quoted on our site, except in cases of obvious error. Please be aware that these prices include VAT at the current rate.
Due to the large number of Goods on our site it is always possible that, despite our best efforts, some of the Goods listed on our site may be incorrectly priced. We will normally verify prices as part of our order-handling procedure. If the Good’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Goods, or reject your order and notify you of the reasons for the rejection. In the event a product is listed at an incorrect price due to recent taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a refund to your credit card account in the value of monies paid (including any delivery charges).
The price of any item purchased online may differ in price from that same item available in our store; sometimes this will be lower and occasionally higher. All products offered are subject to availability.
All items are subject to stock availability. We will inform you as soon as possible if, for any reason, the Goods you have ordered are not available. Please note that, on rare occasions, stock may become unavailable after we have accepted your order. In such circumstances, we may need to cancel the Contract with you. In such circumstances, if we have taken payment from your credit card or debit card we will refund the amount paid by you in full and we will thereafter have no other liability to you.
Please be aware that not all products illustrated on our website are on display in our retail outlet - space obviously limits us as to just how much we are able to display. Also, we often have in store products not shown on our website.
There may be occasions too when the offers/prices in store differ from those on this website and vice versa.
Bedwarehouse.com retains the right to investigate any order placed on this website that it suspects to be fraudulent, any such order will not be delivered until it is proven that the order is bona fide. Should Bedwarehouse.com be unable to prove that an order is bona fide or to contact the Buyer then the monies will be refunded to the original card used to place the order and the order will be cancelled.
For your protection, to ensure that your credit, debit or charge card is not being used fraudulently, we will validate your name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
The description of the goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the Goods specified are as the Buyer intended to order. Images of products are examples of the finished product and goods are supplied on the understanding that there may be slight variances in colour, finish, shade and grain particularly on wooden and metal products. Raw materials may have minor technical variances and products may differ marginally from the goods shown. Any changes made will be of an equally or higher standard.
All sizes quoted are approximate and the Buyer should satisfy them self that the goods will fit into the delivery address. The normal bed and mattress sizes refer to the sleeping surface only and the Buyer should be aware that the overall dimensions may be greater. There may be certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order, (for example, mattresses on bedsteads & bunks, bedside tables, lamps, pillows and bedcovers).
Full payment is required at the time the order is placed and Bedwarehouse.com will collect the payment from the debit/credit card details supplied. All Prices and charges on this site are in U.K. pounds and include any V.A.T payable at the prevailing rate.
Delivery is usually Free* for orders placed online within our Free* delivery area as described above.
For deliveries outside the above post code areas please contact us first on Scarborough 01723 351313 to find out if we are able to deliver to your area and the likely delivery charge.
Please note that we may deliver your order in stages.
Any delivery lead times quoted on the site are intended as a guide only. We aim to deliver all orders within 28 days* of acceptance of the order but give no guarantee of delivery within this period. A member of the Bed Warehouse team will contact you with delivery details should we be unable to deliver within 28 days.
*n.b. Hypnos beds, mattress and headboards my take up to 6 weeeks.
When you have chosen the Goods you want to buy from us, the delivery address will default automatically to the billing address you have entered for your payment card. If you want us to deliver your order to a different address, you can choose this option as you go through the checkout process. Although we will make every reasonable effort to ensure your Goods are delivered within the timescales given above, unfortunately we cannot guarantee that they will not be affected by unforeseen issues affecting our delivery partners. Where your delivery is delayed by unforeseen circumstances we will work with our delivery partners to get your Goods to you as soon as possible. We do not refund delivery charges (if any) in such circumstances.
Either we or our contractors will contact you to arrange for delivery of the Goods and will give you a delivery day. If delivery is attempted during that day and you are not available to take delivery, we reserve the right to charge you for any loss that we may suffer as a result and for any further attempts to deliver the Goods.
Deliveries are often 2 man for large items, sometimes they are 1 man. Goods may be delivered by our own delivery team or delivered directly from our suppliers or another professional logistic team. Smaller Goods may be delivered by post or courier.
Deliveries are usually Monday to Friday within our delivery area outlined above.
Delivery will only be made to the delivery address specified on the original order.
Delivery will be deemed to have taken place when the Goods have been delivered to the agreed address. Bedwarehouse.com do not need to satisfy themselves that the person accepting delivery at the agreed address is authorised by the Buyer to accept the Goods.
You will be given time to check your goods carefully for any visible damage before signing for them. Please note that it is your responsibility to sign for the delivery as received, should your packaging be damaged, please mark this on the delivery note as failure to do so may result in any future claim for replacements due to damage being invalidated.
Delivery is officially to the front door only but Goods may be taken to the room of your choice if the access is clear. It is the customer's responsibility to ensure that the goods will fit into the chosen location and that there is satisfactory access to the chosen location.
Most Goods will require some form of assembly and it is the Buyer's responsibility to assemble the Goods.
Delivery, whether charged or not, does not include unpacking or assembly. Please inspect all goods on delivery and advise us of any visible damage as soon as possible.
The deliverers will not remove existing pieces of furniture to help make room for newly delivered products. The customer must take the responsibility to organize the removal and disposal of unwanted furniture. Likewise, old pieces of furniture will not be taken away unless this has been arranged with bedwarehouse.com prior to delivery. Where this service is requested and is available there will be a charge made and the customer will agree to this charge prior to delivery.
Customers are advised when accepting goods to have protective sheets available as the goods being delivered may have transferred through a number of warehouses and delivery vehicles.
Where the Goods cannot be delivered on the day arranged due to the fault of the buyer, Bedwarehouse.com retains the right to charge a further £45 for "re-delivery" to cover costs incurred. This charge will be taken from the debit/credit card used to purchase the Goods.
Refunds on Goods canceled prior to delivery will be made as soon as possible following written notification of cancellation and in any case will not exceed a period of 14 days of that written notice. All refunds will be made onto the same card used to make the original purchase.
Refunds on Goods already delivered will take place as soon as possible following the collection, return and inspection of such goods and in any case will not exceed a period of 14 days following that collection/return.
The Buyer may cancel the goods at any time within the cancellation period by giving Bedwarehouse.com notice of the cancellation in writing or in another durable medium.
If you are unhappy with your purchase or change your mind, and notify us within 14 days starting on the day after the day on which you receive the goods, we will offer you a choice of either exchange to another product or collection and refund of the goods. If your order is delivered in stages you may cancel at any time up to 14 calendar days starting on the day after the day on which you receive the final part of the delivery. Provided you comply with these Terms and Conditions and take reasonable care of the Products, you will receive a full refund of the price paid for the Goods in accordance with our returns policy (set out below). Although we reserve our right to recover the cost of collection, which would be deducted from the refund amount. This applies only to Goods featured and purchased online from the bedwarehouse.com web site.
If the Goods have been processed for delivery or have been delivered at the time you notify us of your wish to cancel the Contract, then the Goods must be returned to us at your own risk. We will arrange for the Goods to be collected from you either by us or by a third party, a collection charge will be made for this; however if you prefer, and at your cost, you may make your own arrangements for the return of the Goods to Bed Warehouse, Wrea Lane, Scarborough, North Yorkshire YO12 7PN providing that you have notified us of your intention to do so in writing, and the return is made within the cancellation period.
If you have canceled the Contract and the Goods have not been delivered, nor are they in the delivery process, then you will receive a full refund for both the goods and the delivery charge. We will process the refund due to you as soon as possible and, in any case, within 14 days of the day following the day on which you gave us notice of cancellation of the Contract.
Special Items i.e. Bespoke items, manufactured specifically for the Buyer, cannot be cancelled once the order has been accepted by Bedwarehouse.com.
Please be aware that due to the intimate nature of Beds, mattresses, pillows, mattress protectors, duvets etc, these items are exempt from the statutory 14 day cooling off period when they have been unsealed. Therefore, for reasons of health protection and hygiene any mattresses or bedding that has been unsealed will be deemed to be used and cannot be returned for any reason other than a manufacturing fault.
The Goods must be unused, made available for collection and be properly packaged and in the original saleable condition at a time requested by Bedwarehouse.com (this request not to exceed 14 days from the cancellation date).
The Buyer must retain the Goods and take good care of them until they are collected by Bedwarehouse.com or their agents.
Should the Goods not be adequately packaged at the time of collection then they will not be collected and Bedwarehouse.com retain the right to charge a further £45 for "re-collection" to cover costs incurred. The "re-collection" charge will be deducted from the refund value.
Following collection or return, should Goods be found to be damaged (not in their original saleable condition), and the Damage is not the result of our actions or negligence, Bedwarehouse.com will deduct a reasonable amount from the refund to cover such damage. (Such amount not to exceed the price of the Goods).
Should the buyer unreasonably fail or refuse to make the Goods available to us when requested within 14 days then it will be deemed that the buyer has decided to keep the goods at the price paid and in the condition they are in. Goods must be kept and good care taken of them until they are collected or returned. No refund shall be made until the Goods have been collected/returned and inspection made as to their condition.
All Goods are guaranteed against faulty materials and workmanship for a minimum period of twelve months from the date of delivery.
Complaints relating to incorrect, faulty or damaged Goods should be notified by phone on 01723 351313 and in writing as soon as possible after delivery and should be addressed to Customer Services Department at the address below or by e-mail to email@example.com. We will offer you either the choice of an exchange of faulty part or product; or Collection with full refund. This does not affect your statutory rights. In the rare event that Goods develop a fault, Bedwarehouse.com retains the right to have the Goods repaired or replaced at Bedwarehouse.com’s discretion, and any delivery costs associated with the exchange of faulty Goods will be met by Bedwarehouse.com.
Where Goods are reported as faulty within 6 months after delivery, we reserve the right to arrange an independent inspection and if the Goods are found on inspection to not be faulty but the result of fair wear and tear, negligence or wilful damage, Bedwarehouse.com retains the right to charge the Consumer for the inspection to cover its costs. The Buyer and Bedwarehouse.com shall both agree to be bound by the results/findings of the independent inspector.
